Michigan Foreclosure Cases at the Dailey Law Firm

The Dailey Law Firm’s Justin Grove has been busy helping people protect thier homes. Here is a summary of just some of our recent work.

Client v. MERS, US Bank, ASC, BNC Mortgage and IT Mortgage

- US District Court Eastern District
Our client was facing foreclosure 2 years ago. They are still in their home today and have not been evicted. We are working on voiding the foreclosure.

Client v. Liquidation Properties

- US District Court Eastern District
March 2011 Defendant Motion for Summary Disposition Granted- Court mistakenly determined MERS did have right to foreclose on Plaintiff. Client has been facing eviction for three year and is still in their home.

Bank of America, NA v. client:

-55th District Court- Ingham County
Court ordered a reversal of the sheriff sale. Set aside the foreclosure.

Wells Fargo Bank, NA v Client

-52nd District Court
Retained by client day of eviction hearing and successfully stopped eviction and demanded Plaintiff produce a copy of the note.  Plaintiff has been unable to produce the note and eviction has been stayed. We are working on a load modification for the client.

Client v. Bank of New York Mellon and BAC Home Loans

-Oakland County Circuit Court
Successfully stopped eviction action despite client not making a mortgage payment in nearly three years. We are reviewing settlement offers with the bank at this time.

Fannie Mae v. Client

- 52-1 2-District Court
Retained 2 days prior to eviction hearing, successfully stopped eviction action and have filed Quiet Title Action in Oakland Circuit Court.

Citigroup Global Markets Realty v. Client

- 41-A District Court
Retained day prior to eviction hearing, successfully stopped the eviction and have filed action for Quiet Title and other relief in the Macomb Circuit Court. Currently negotiating for the repurchase of the home

Client v. BAC Home Loans Servicing, LP

- Oakland County Circuit Court
Retained to action for Quiet Title and other relief. Challenging Defendant’s claim that BAC had the power to initiate foreclosure action, whether they can produce the original note at issue, as well as numerous violations of the Michigan Foreclosure by Advertisement Statute.

Client v. Saxon Mortgage Inc.

-Oakland Circuit Court
Retained by Client to challenge Saxon’s ability to conduct the foreclosure and sheriff sale of client’s home. Further challenging client’s denial from HAMP program as they made all necessary payments under loan modification agreement and were still foreclosed upon.
