Updated: Tuesday, 22 Nov 2011, 5:32 PM EST
WJBK | myFOXDetroit.com

ROYAL OAK, Mich. (WJBK) – An ambulance service for the DMC is facing some serious allegations. A lawsuit claims workers and supervisors acted inappropriately on the job. Three women have come forward saying they were sexually harassed and it happened a lot.

“I had asked to get some equipment from my truck that was in lockup. I told Adam that I needed it and he told me I could have it, but I’d have to show him my breasts first,” said Cassandra Drew.

“I woke up from a nap once with Adam straddling over me,” said Kimm Flynn.

“He calls for my attention. I turn around and he’s clearly exposed,” said Amanda Huber.

These women claim the people behind these disgusting allegations were supervisors. They worked at DMCare Express, an ambulance company based in Detroit. They say while they were working to save lives, their bosses were targeting them for sex and ignored their calls for help.

“To know that my supervisors looked upon me as basically a piece of meat, it was absolutely humiliating,” Flynn explained.

She claims one of her supervisors sent her a text message asking for a birthday lap dance in his office.

Meanwhile, Huber says another supervisor started touching himself while they were in an ambulance.

“It’s not like I can jump out of the ambulance in the middle of my shift in the middle of Detroit,” she told reporters.

FOX 2 asked Huber what the reaction was when she reported the incident.

“There wasn’t any reaction at all,” she responded.

Each of them say they were fired after they reported the harassment.

DMCare Express released a statement that says, in part, “Contrary to the allegations, DMCare Express did not discipline or discharge any employee as a result of reporting sexual harassment. Did not fail to act quickly or responsively once allegations were reported, and does not foster a workplace where harassment of any kind is permitted.”

However, these women aren’t buying that and they’ve hired attorney Brian Dailey to prove that in court.

“If there [are] allegations where the employees were being assaulted and molested and harassed, it seems like it ought to be something that is subject to some investigation. We’re asking anybody who is in the public who is aware of any circumstances like this with DMCare Express to come forward and let us know,” he said.

Dave Phillips Story from November 22, 2011

Oakland County woman files sexual harassment lawsuit against Detroit ambulance company

By DAVE PHILLIPS
Of The Oakland Press

Three women — one of whom is from Oakland County — have filed a lawsuit against their former employer, DMCare Express, amid several sexual harassment claims against some of their former co-workers.

DMCare Express contends the allegations are false in a statement released Tuesday.

Represented by the Dailey Law Firm of Royal Oak, Kimberly Flynn, Amanda Huber and Cassandra Drew spoke about the allegations during a Tuesday morning press conference.

One incident occurred on April 20, 2009, according to a lawsuit filed in Wayne County Circuit Court. The defendants accuse Chris Zugel — a supervisor — of soliciting a lap dance from Flynn.

“At least a lap dance. I did put blinds on my office 4 a reason,” reads one text from Zugel to Flynn, which was submitted as Exhibit 1.

“Its my birthday n i hav never gotten a lapdance in my office. If u had the guts that would redefine my perceptions of u. 4 the better,” read another text from Zugel, who was Flynn’s boss at the time.

Zugel continues on to call Flynn “timid,” a “sissy” and a “panzy,” according to the lawsuit.

Flynn reported the texts to Terrye Nicholls, who said the incidents would be kept secret and did not take any further action, according to the lawsuit.

Adam Williard — another defendant named in the lawsuit — is accused of several inappropriate acts, including asking Huber to remove her shirt or perform sexual favors in exchange for better treatment, laying in Huber’s bed during an overnight shift and refusing to leave, asking Huber what she thought of his erect penis after exposing it to her, and masturbating in front of her in an on-call ambulance around midnight in the middle of Detroit.

Williard and Zugel are also accused of making unwanted sexual advances toward all three plaintiffs in the presence of Nicholls. Continued…

* See Full Story

“DMCare Express takes these allegations very seriously and contends the accusations against DMCare Express are false,” reads a statement.

“DMCare Express has always had a zero tolerance policy against sexual harassment in the workplace. Once an allegation was reported, DMCare Express acted swiftly and consistency with its policy.”

The company hired a third-party investigator to examine the accusations, disciplined employees in violation of the policy, re-educated all employees in harassment training, procedures and policies and re-emphasized the company’s commitment to a safe, professional workplace free of harassment, according to the statement.

All three plaintiffs believe they lost their jobs due to reporting the sexual assault. The company says that is not true.

“Contrary to the allegations, DMCare Express did not discipline or discharge any employee as a result of reporting sexual harassment, did not fail to act quickly or responsively once allegations were reported, does not foster a workplace where harassment of any kind is permitted (and) was never the site of any reported sexual assault,” the statement reads.

Thousands of Michigan foreclosures nullified from the court of appeals

A recent Michigan Court of Appeals ruling handed down late last week has invalidated thousands of Michigan foreclosures. The Michigan Court of Appeals ruled that “Mortgage Electronic Registration Systems, Inc. (MERS) , a third party in the mortgage process, lacked the authority to foreclose on Michigan properties.” MERS has filed thousands of Michigan foreclosures.

Attorney and radio talk show host Brian Dailey of the Dailey Law Firm, PC of Royal Oak said, “This decision brings into question virtually each and every foreclosure that was completed by MERS or under similar circumstances.” Dailey went on to say, “This decision could result in the restoration of previously foreclosed properties to their original owners and in some cases damages to homeowners for abuse of process, malicious prosecution, violation of legal rights, conversion, fraud, theft, and wrongful foreclosure.”

MERS was set up in 1993 by several large participants in the real estate mortgage industry to keep track of loans bought and sold by financial institutions. By using MERS, banks could buy and sell loans without having to record a mortgage transfer for each transaction with the local register of deeds.

Dailey recommends homeowners in Michigan who are currently in the process of foreclosure or who have been recently foreclosed should contact a lawyer immediately. Consumers looking for information can visit michiganforeclosurefacts.com or thelawshow.com for more information.

Dailey said, “This case is likely to assist thousands of recently foreclosed home owners in Michigan. Everyone who has been subject to foreclosure in the last 48 months should seek counsel for an analysis of their own situation.”
Brian Dailey is the founder of The Dailey Law Firm in Royal Oak, Michigan. Dailey is the host of The Law Show broadcast each Sunday at 11am on NewsTalk 760 WJR. Dailey has been hosting a weekly legal radio program in metro Detroit for 12 years.

Customers report the Ford recall does not solve the problem.

Michigan Lemon Law Attorney Steve Lehto on Problems with the Ford Escape.

Recently, we have been receiving a lot of calls from people who own Ford Escapes with defective transmissions. While we encounter car owners from across the spectrum of car ownership, the number of Ford Escape complaints we have seen is remarkable. The consumers who have contacted us have similar complaints: the automatic transmissions in their Escapes “slip” – a condition that results in harsh shifting. The vehicles will bang into gear. Sometimes the car will stay in gear too long, and then slam into the next gear. The engine RPMs will swing wildly up and down.

Ford is aware of the problem. They have issued at least one recall (#10B15) on this problem, but customers report to us that the recall does not solve the problem. Some customers are told that they are the only ones who are reporting this condition. Other customers are told that there is a problem with their car but that the dealer cannot fix it. Some have been told that Ford is “working” on the problem, and that they should wait a little longer.

If you own a 2010 Ford Escape, here is what you need to do.

1.	Pay close attention to how your vehicle shifts. If it acts up, take it in immediately for repair to your Ford Dealer.

2.	Make sure they document the problem with the transmission on your repair order and get a copy of the repair order for yourself.

3.	When you get the car back, watch the transmission closely. Some clients have told us that their vehicles were returned to them in exactly the same defective condition as when they dropped it off.

4.	Keep brining your vehicle back for repair until it has been repaired three (3) times. At that point, call us and we can discuss the next step.

The Ford Escape is an expensive vehicle. There is no reason you should be required to put up with repeated repairs to it – especially if those repairs don’t work.
